CCI Finds Grasim Abused Dominace Again: Khaitan & Co

Khaitan & Co. Report

Grasim Industries Ltd. abused its dominance again by charging discriminatory prices, denying market access, and imposing supplementary obligations in the viscose staple fibre market from 2017 to 2018, held the Competition Commission of India on August 06, 2021.

On March 16, 2020, the CCI had earlier imposed a penalty of Rs 301.61 crores on Grasim Industries. Given the penalty imposed on Grasim in MMF Case and considering the close time frame of the two cases, the CCI did not impose a penalty in this order.

The CCI order can be summarily divided into three issues:

  1. what is the relevant market

  2. whether Grasim Industries held dominance in the relevant market, and

  3. whether Grasim Industries had abused its dominance in the relevant market.
