Justice CK Patnaik To Hold Inquiry On Conspiracy Allegation

The Supreme Court of India has ordered an inquiry into the allegations of conspiracy against the Chief Justice of India.

Justice Arun Mishra, part of the three-judge bench looking into the conspiracy allegations at the apex court, said “we have decided there is no privilege and all the information required has to be disclosed”.

“Justice CK Patnaik will inquire into the contents of the affidavit by lawyer Utsav Bains,” Mishra, said adding that he will be assisted by the Central Bureau of Investigation, Intelligence Bureau and the Delhi Police Commissioner as and when required.

The case will next be heard once Justice Patnaik files his report in a sealed cover.

Chief Justice Controversy: Rule Of Law Thrown To The Wind With Parallel Hearings

How is the Supreme Court, on the judicial side and the administrative side, conducting parallel hearings on the same matter, asks senior advocate Indira Jaising, who is intervening in the case before the bench presided by Justice Arun Mishra.

  • We have one enquiry into the sexual harassment allegation on the administrative side, and one into the defence against that allegation on the judicial side.
  • In the latter, the complainant is missing, no notice has been issued to her.
  • Neither complies with the spirit of the Vishaka ruling. Neither has a woman judge presiding.

Apex Court Expresses Anguish Over 'Systematic Attack'

The Supreme Court today expressed anguish over the "systematic attack" on the judiciary and said the time has come to tell the rich and powerful of this country that they are "playing with fire".

The comments were made while hearing claims made by advocate Utsav Bains.

A special bench headed by Justice Arun Mishra said that it was anguished with the way the judiciary has been treated for the past three to four years.

"The way this institution is treated in last few years we must say that we will not survive if this will happen," a bench also comprising Justices RF Nariman and Deepak Gupta said.

“There is a systematic attack, systematic game to malign this institution”, the bench said.

Supreme Court To Pass Order On Conspiracy Claims

The Supreme Court of India is set to pass its order on claims made by advocate Utsav Bains, who claimed there was a larger conspiracy at play behind the sexual harassment allegations against Chief Justice of India Ranjan Gogoi.

The order will be passed at 2 p.m. today.

The lawyer claimed that he was also offered Rs 1.5 crore to represent a former apex court woman employee and arrange a presser against the CJI at the Press Club of India in New Delhi, and that it was an attempt to discredit the Indian judiciary.

The lawyer had filed an affidavit on Monday following the unprecedented hearing on Saturday during which the CJI said a larger conspiracy was behind it and that he would not stoop too low, even to deny the allegations.

On April 24, in a second affidavit, he claimed that the conspirators include two court masters that were recently dismissed by Justice Gogoi.
