ELP Report
In 2009, under the aegis of National Highways Act, 1956 various notifications were issued by the central government to facilitate speedy land acquisition for construction of national highways.
The National Highways Act and the notifications inter alia provided that -
the compensation payable to the landowner for the acquired land would be computed by the ‘competent authority’;
if the amount determined by the competent authority was not acceptable to either the National Highways Authority of India or the landowner, upon an application by either party, the compensation would be determined by an arbitrator appointed by the Central Government; and
subject to the provisions of the National Highways Act, the provisions of the Arbitration Act would apply to such arbitrations.
